Gardeners Bayswater Service Terms and Conditions
These Terms and Conditions set out the basis on which Gardeners Bayswater provides gardening and related services to customers. By making a booking, accepting a quotation, or allowing our gardeners to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before placing your booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual or business requesting gardening services from Gardeners Bayswater.
Services means any gardening, garden maintenance, lawn care, planting, hedge trimming, clearance, outdoor cleaning, or related works provided by Gardeners Bayswater.
Property means the garden, outdoor space, or other premises at which the Services are to be carried out.
Contract means the agreement between Gardeners Bayswater and the Customer for the provision of Services, which incorporates these Terms and Conditions.
2. Scope of Services
Gardeners Bayswater provides a range of gardening and outdoor maintenance services. The specific Services to be supplied will be agreed at the time of booking or as set out in a written quotation or confirmation.
The Services may include, but are not limited to, lawn mowing, lawn care, weeding, pruning, planting, hedge cutting, garden tidy-ups, garden clearance, green waste handling in accordance with regulations, and regular garden maintenance visits.
Any description or illustration of the Services is for general guidance only and does not form part of the Contract unless expressly stated in writing.
3. Booking Process
Bookings for gardening Services may be made by the Customer through our online enquiry forms or in writing. By submitting a booking request, the Customer confirms that they are at least 18 years of age and authorised to enter into a contract for the Property.
Following a request, Gardeners Bayswater may provide an estimate or quotation based on the information supplied by the Customer. In some cases, a site visit may be required to assess the garden, access, and nature of the work before confirming a price.
The Contract is formed when Gardeners Bayswater confirms acceptance of the booking, either by written confirmation, issue of a work order, or by commencing the Services on the agreed date.
The Customer is responsible for providing accurate information during the booking process, including the Property address, access arrangements, and any known risks or restrictions that could affect the Services.
4. Quotations and Pricing
Any quotation or estimate provided by Gardeners Bayswater is based on the information available at the time and may be subject to change if the scope of work is altered, additional tasks are requested, or site conditions differ materially from those described.
Prices may be calculated on an hourly rate, a fixed price per visit, or a fixed price per job, as specified in the quotation or confirmation. Gardeners Bayswater reserves the right to amend its rates from time to time. Changes will not affect work already booked and confirmed, except where additional Services are requested.
If, during the course of the work, it becomes evident that additional work is necessary, Gardeners Bayswater will inform the Customer and seek approval before proceeding with any extra Services that would increase the price.
5. Access to the Property
The Customer must ensure that Gardeners Bayswater and its gardeners have safe and reasonable access to the Property at the agreed times. This includes access to outdoor areas, gates, garages, and any facilities that have been agreed in advance.
If access is not available or is significantly delayed due to the Customer, Gardeners Bayswater may charge for the wasted attendance or waiting time at the standard hourly rate or a minimum call-out fee.
The Customer must ensure that pets, children, and other occupants are kept away from work areas for safety reasons, and that any known hazards are disclosed before work commences.
6. Customer Obligations
The Customer agrees to:
Provide clear instructions regarding the work required, either at booking or during the initial site assessment.
Ensure that any necessary permissions, consents, or approvals for the work, including from neighbours or local authorities, are obtained before the Services commence.
Inform Gardeners Bayswater of any underground services, cables, pipes, or irrigation systems that could be affected by the gardening works.
Remove personal items, garden furniture, or obstacles that may impede the Services, unless otherwise agreed.
Cooperate with Gardeners Bayswater to allow the Services to be carried out efficiently and safely.
7. Payments and Invoicing
Payment terms will be confirmed at the time of booking or stated on the invoice. Gardeners Bayswater may require payment on completion of each visit, in advance for certain Services, or on account for regular maintenance programs, as specified to the Customer.
Invoices will set out the Services provided, the date of the work, and the amount payable. The Customer must pay all invoices in full by the due date indicated. Failure to pay on time may result in suspension of further Services and the application of late payment charges where permitted by law.
Gardeners Bayswater may accept various methods of payment as notified to the Customer from time to time. Cash payments may be subject to specific arrangements and must be confirmed in advance.
All prices and charges are stated inclusive or exclusive of applicable taxes as specified at the time of booking or on the invoice.
8. Cancellations and Rescheduling
The Customer may cancel or reschedule a booking by giving reasonable notice. Unless otherwise agreed, at least 24 hours notice before the scheduled visit is required to avoid a cancellation fee. Short notice cancellations or missed appointments caused by the Customer may be charged at the minimum call-out rate or a proportion of the booking value.
Gardeners Bayswater reserves the right to cancel or reschedule appointments due to weather conditions, staff illness, safety concerns, or other circumstances beyond its reasonable control. In such cases, Gardeners Bayswater will endeavour to offer the Customer an alternative date and time as soon as practicable.
For larger projects or works where materials have been specially ordered, additional cancellation terms may apply as set out in the quotation or written agreement, including potential charges for materials or preparation time already incurred.
9. Service Standards and Complaints
Gardeners Bayswater aims to provide Services with reasonable care and skill and in accordance with industry practices for gardening and garden maintenance.
If the Customer is dissatisfied with any aspect of the Services, they should raise the issue promptly, ideally within 48 hours of completion of the visit. Gardeners Bayswater will investigate and, where appropriate, seek to remedy any valid concerns, which may include revisiting the Property to address specific points.
Any adjustments or remedial work offered will be at the discretion of Gardeners Bayswater and will take into account the nature of the Services provided, the condition of the garden, and reasonable expectations for gardening work.
10. Tools, Equipment, and Materials
Unless otherwise agreed, Gardeners Bayswater will supply all necessary tools and standard equipment required to perform the Services. In some cases, the Customer may request that their own equipment be used; this will be at the sole discretion of Gardeners Bayswater and at the Customer's risk.
Where materials such as plants, turf, soil, mulch, or chemicals are supplied by Gardeners Bayswater, these will be of reasonable quality suitable for the intended purpose. Variations in growth, appearance, and performance may occur due to factors beyond our control, including weather, soil conditions, and ongoing maintenance by the Customer.
If the Customer provides materials, Gardeners Bayswater does not accept responsibility for their quality or suitability. Any additional work caused by defective customer-supplied materials may be charged separately.
11. Waste Handling and Regulations
Gardeners Bayswater will endeavour to handle garden waste in accordance with applicable waste and environmental regulations in the United Kingdom. The approach to green waste and other waste will be agreed with the Customer in advance.
In some cases, garden waste can be left in the Customer's designated composting or green waste containers, provided this is agreed and lawful. Larger volumes of waste or non-green waste may require collection and disposal by licensed carriers, which may incur additional charges.
The Customer is responsible for informing Gardeners Bayswater of any local restrictions or requirements relating to waste at the Property. Gardeners Bayswater will not remove hazardous waste or items prohibited by law. Waste handling will be carried out with regard to environmental considerations and regulations applicable at the time of service.
12. Health and Safety
Gardeners Bayswater takes health and safety seriously and will carry out Services in a manner designed to minimise risk to people, property, and the environment.
The Customer must inform Gardeners Bayswater of any specific health and safety concerns at the Property, such as uneven ground, sharp objects, hazardous substances, or aggressive animals. Failure to disclose such information may increase risk and could lead to suspension of work.
Gardeners Bayswater may refuse to carry out, or may stop, any work that it considers unsafe or contrary to health and safety or environmental regulations. Any rearranged work will be agreed on a case-by-case basis.
13. Liability and Insurance
Gardeners Bayswater will exercise reasonable care and skill in providing the Services. However, gardening work by its nature may involve some inherent risks to plants, lawns, and existing garden features.
Gardeners Bayswater will not be liable for:
Normal wear, tear, or deterioration of plants, lawns, or garden features arising from weather, pests, diseases, or Customer neglect.
Damage resulting from inaccurate information supplied by the Customer, including undisclosed underground services or hidden obstacles.
Any indirect, consequential, or economic loss, including loss of enjoyment or loss of business, arising from the Services.
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited or excluded.
Gardeners Bayswater maintains appropriate insurance cover for its gardening operations as required by law and good practice.
14. Planting, Turf, and Garden Outcomes
Where Gardeners Bayswater undertakes planting, turfing, or similar works, the success and appearance of the garden will depend on ongoing care, watering, feeding, and maintenance by the Customer after completion of the Services.
Gardeners Bayswater cannot guarantee specific growth rates, flowering times, or long-term survival of plants or turf due to factors such as weather, soil, pests, and maintenance outside our control.
Any guidance provided on aftercare is for general information and does not form a warranty. The Customer is encouraged to follow recommended care instructions to support the best possible results.
15. Force Majeure
Gardeners Bayswater shall not be in breach of the Contract or liable for any delay in performing, or failure to perform, any of its obligations if such delay or failure results from events, circumstances, or causes beyond its reasonable control, including extreme weather, flooding, storms, fire, accidents, labour disputes, or interruptions to transport or utilities.
Where a force majeure event occurs, Gardeners Bayswater will inform the Customer where reasonably possible and will endeavour to resume the Services as soon as it is reasonably practicable.
16. Termination of Services
For ongoing regular maintenance arrangements, either party may terminate the Services by giving reasonable notice, typically not less than 14 days, unless a different notice period has been agreed in writing.
Gardeners Bayswater may terminate the Services with immediate effect if the Customer materially breaches these Terms and Conditions, fails to pay invoices when due, or engages in abusive or unsafe behaviour towards our gardeners.
On termination, the Customer must pay for all Services provided up to the termination date, including any agreed materials or costs incurred.
17. Data Protection and Privacy
Gardeners Bayswater may collect and process personal data necessary to manage bookings, deliver Services, and handle payments and communications. Personal data will be handled in accordance with applicable data protection laws in the United Kingdom.
The Customer's details will not be sold to third parties. Information may be shared with trusted partners or service providers solely for the purpose of delivering the Services, processing payments, or complying with legal obligations.
18. Changes to these Terms and Conditions
Gardeners Bayswater may update or revise these Terms and Conditions from time to time. The latest version will apply to new bookings and Services. For ongoing regular maintenance arrangements, reasonable notice of material changes will be given where practicable.
Continued use of the Services following notification of updated terms will constitute acceptance of the revised Terms and Conditions.
19. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Gardeners Bayswater.
20. General Provisions
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable.
No failure or delay by Gardeners Bayswater in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy.
These Terms and Conditions constitute the entire agreement between Gardeners Bayswater and the Customer in relation to the Services and supersede any prior discussions or understandings, whether written or oral.
